Comments on the Grokster win

I was busy packing last week when the decision in favor of the EFF/Grokster came down. It is nice to see EFF win this one it is a very fundamental win that will have positive implications as more of these types of cases go to court. With decentralized P2P the creator of the software is not help liable to make it easy for the RIAA and MPAA to spy on who is trading what. This is a landmark victory and may finally force the studios to embrace the technology they have been fighting in the courts so hard over the past couple of years. [Boing Boing]

Quote from the EFF Site:

“Ninth Circuit Opinion affirming district court: “This appeal presents the question of whether distributors of peer-to-peer file-sharing computer networking software may be held contributorily or vicariously liable for copyright infringements by users. Under the circumstances presented by this case, we conclude that the defendants are not liable for contributory and vicarious copyright infringement and affirm the district court’s partial grant of summary judgment.” (Aug. 19, 2004)”
